JAKARTA – Inforayanews.co.id, – Berdasarkan keterangan saksi-saksi, alat bukti dan keterangan Ahli Puspom resmi menghentikan kasus dugaan tindak pidana penistaan agama yang dilakukan Kasad Dudung AR atas laporan pengaduan Ahmad Syahrudin tentang pernyataan Jenderal TNI Dudung Abdurachman dalam video yang dipublikasikan di podcast YouTube Deddy Corbuzier pada 30 Desember 2021 lalu, dalam wawancara berdurasi 1:09:31,karena tidak memenuhi unsur perbuatan tindak pidana seperti yang dilaporkan, sehingga tidak dapat dilanjutkan ke tahap penyidikan.
Hal tersebut disampaikan Kapen Puspomad Agus Subur Mudjiono, S.H., M.A.P., saat menyampaikan hasil penyelidikan oleh tim penyelidik Puspomad terkait laporan pengaduan tersebut di Puspomad, Jakarta Pusat. Rabu, (23/2/2022)
Disampaikannya, tim penyelidik Puspomad telah melakukan penyelidikan mulai tanggal 9 s.d. 22 Februari 2022 dengan mengundang pelapor, saksi dan meminta keterangan ahli hukum pidana dari Universitas Airlangga Surabaya, ahli ITE dari Kemkominfo serta dua orang ahli Bahasa Indonesia dari Universitas Indonesia (UI).
Disampaikan Kapen Puspomad, berdasarkan keterangan ahli hukum pidana, disimpulkan bahwa pernyataan Jenderal TNI Dudung Abdurachman dalam video yang dipublikasikan di podcast YouTube Deddy Corbuzier, tidak memenuhi unsur subyektif dan obyektif sebagaimana dimaksud Pasal 156 KUHP, Pasal 156a KUHP, Pasal 14 dan Pasal 15 UU RI Nomor 1 Tahun 1946 tentang Peraturan Hukum Pidana, dan Pasal 16 UU Nomor 40 Tahun 2008 tentang Diskriminasi Ras dan Etnis,serta Pasal 27 ayat (3) Jo. Pasal 45 dan 28 ayat (2) Jo. Pasal 45 a ayat (2) Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagaimana yang telah diubah oleh Undang-Undang RI Nomor 19 Tahun 2016 tentang perubahan atas Undang-Undang RI Nomor 11 tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE).
Lebih lanjut Kapen Puspomad juga menjelaskan hasil keterangan ahli ITE, yang menyimpulkan bahwa pernyataan Jenderal TNI Dudung Abdurachman tersebut, tidak memenuhi unsur perbuatan tindak pidana, sebagaimana diatur dalam Pasal 27 ayat (3) Jo Pasal 45 dan 28 ayat (2) Jo Pasal 45 a ayat (2) Undang-Undang RI Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) sebagaimana yang telah diubah oleh Undang-Undang No.19 Tahun 2016 tentang perubahan atas Undang-Undang RI Nomor 11 tahun 2008 tentang Informasi dan Transaksi Elektronik..
“Demikian juga keterangan ahli Bahasa Indonesia, yang menyatakan bahwa pernyataan tersebut tidak bermakna mensejajarkan Tuhan dengan manusia atau makhluknya dan tidak mengandung muatan penodaan agama yang disangkakan pelapor Ahmad Syahrudin,” oleh karena itu telah dikeluarkan SP2 Lidik pungkas Kapen Puspomad.
