BANDUNG – Inforayanews.co.id, – Terdakwa kasus pemerkosaan 13 santriwati dituntut hukuman mati dan dikebiri kimia, hal itu disampaikan langsung oleh Jaksa penuntut umum (JPU) dari Kejaksaan Tinggi (Kejati) Jabar, Jaksa menilai hukuman mati dan kebiri sesuai dengan perbuatan Herry Wirawan.
Tuntutan hukuman tersebut dibacakan oleh tim JPU yang dipimpin Kajati Jabar Asep N Mulyana dalam sidang tertutup yang digelar di Pengadilan Negeri (PN) Kelas 1A Khusus Bandung, Jalan RE Martadinata, Selasa (11/1/2022).
Terdakwa Herry Wirawan hadir untuk mendengarkan tuntutan. (HW) Predator seks itu hadir mengenakan kemeja putih dan celana hitam,sekaligus mengenakan rompi merah serta kopiah hitam.
Asep N Mulyana menyatakan, hukuman mati dan kebiri diberikan sesuai perbuatan Herry yang sesuai dakwaan memperkosa 13 santriwatinya sendiri hingga hamil dan melahirkan.
“Ini bukti komitmen kami untuk memberikan efek jera kepada pelaku dan pihak lain yang melakukan kejahatan (asusila),” kata Asep N Mulyana.
Kajati Jabar ini menuturkan, Herry dituntut hukuman itu sesuai Pasal 81 ayat (1), ayat (3) Dan (5) jo Pasal 76.D UU R.I Nomor 17 Tahun 2016 yentang Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak jo Pasal 65 ayat (1) KUHP sebagaimana dakwaan pertama.
JPU juga meminta majelis hakim menjatuhkan pidana tambahan pengumuman identitas terdakwa. “Identitas terdakwa disebarkan,” tutur Kajati Jabar.
Tuntutan ini sesuai harapan dari masyarakat agar Herry Wirawan layak dihukum jauh lebih berat daripada 20 tahun penjara. Bahkan Komisi Nasional Perlindungan Anak (Komnas PA) menilai Herry Wirawan layak dihukum kebiri, penjara seumur hidup, atau bahkan diganjar hukuman mati.
Kendati demikian, Kepala Kejati Jabar Asep N Mulyana akan mempertimbangkan desakan masyarakat untuk menjatuhkan hukuman kebiri, penjara seumur hidup, dan mati terhadap terdakwa Herry Wirawan. Kejati Jabar akan melihat perkembangan serta fakta-fakta persidangan.
Fakta-fakta persidangan mengungkap kekejian dan kejahatan Herry Wirawan terhadap para santriwati. Kajati Jabar Asep N Mulyana sekaligus jaksa penuntut umum (JPU) dalam perkara ini menyatakan, kejahatan Herry Wirawan sangat luar biasa dan telah terencana.
Aspirasi masyarakat terkait hukuman yang pantas terhadap Herry Wirawan itu berkembang setelah terungkap kekejian dan kegilaan Herry Wirawan di persidangan kasus pemerkosaan santriwati di PN. Terdakwa Herry Wirawan kerap memperkosa santriwati korban di depan istrinya sendiri.
Para santriwati dan istri dicuci otaknya oleh Herry. Sehingga, Herry leluasa melakukan pemerkosaan selama 5 tahun dan tak ada yang berani melawan. Selain itu, Herry diduga menggunakan uang bantuan yang diterima yayasan untuk kepentingan pribadi.
Fakta keji dan gila Herry Wirawan itu disampaikan Kepala Kejaksaan Tinggi (Kejati) Jawa Barat Asep N Mulyana sekaligus jaksa penuntut umum (JPU) kasus itu seusai sidang.
Perbuatan cabul terdakwa Herry Wirawan, ustaz atau guru terhadap korban santriwati berlangsung di beberapa tempat selama lima tahun dari 2016 hingga 2021. Berdasarkan berkas dakwaan, pemerkosaan dilakukan Herry di pesantren, mes, apartemen, dan hotel.
Terdakwa Herry memperkosa korban di gedung Yayasan KS, pesantren Tahfiz Madani Boarding School Cibiru, pesantren Manarul Huda Antapani, mes Cibiru Hilir, Apartemen TS Bandung, Hotel A, Hotel PP, Hotel BB, Hotel N, dan Hotel R.
Akibat perbuatan terkutuk ustaz HW, tujuh santriwati korban telah melahirkan sembilan bayi. Bayi-bayi hasil pemerkosaan itu diduga disebut sebagai anak yatim piatu oleh Herry Wirawan untuk menggalang bantuan dari para dermawan.(Sep/Ted)
